5. User Accounts
To use Swipely, you may be required to create an account. You agree to:
Provide accurate, current, and complete information;
Maintain the confidentiality of your login credentials;
Notify us immediately of any unauthorized use of your account;
Be responsible for all activity under your account.
We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.
6. AI and Automated Features
Swipely’s AI assists with job matching, cover letter generation, and application automation.
User Control: You must review and approve any AI-generated application before it is submitted.
Human Oversight: AI recommendations are advisory; final decisions are always under your control.
Limitations: While we strive for accuracy, AI-generated content may contain errors, and Swipely does not guarantee job offers or application outcomes.
7. Content You Provide
You retain ownership of the content you upload (resumes, CVs, cover letters, portfolio materials), but by using our Services you grant Swipely a non-exclusive, worldwide, royalty-free license to:
Process your data for providing the Services;
Share application materials with employers where you apply through Swipely;
Use anonymized data to improve the platform (without identifying you).
You agree not to upload content that:
Violates any laws or third-party rights;
Is offensive, harmful, or discriminatory;
Contains malware or viruses.
8. Payments and Subscriptions
For subscription-based features:
You agree to pay the fees specified at the time of purchase;
Payments are processed securely via third-party providers;
Subscription fees are non-refundable unless required by law;
Swipely may change subscription fees, with notice provided in advance.
9. Data Privacy
Your use of Swipely is subject to our Privacy Policy, which explains how we collect, process, and protect your personal data.
Key points:
We comply with GDPR, UK GDPR, and applicable data protection laws;
You have rights to access, correct, delete, or restrict your personal data;
AI processing is always subject to your review before submission.
10. Prohibited Activities
You may not use Swipely to:

Violate applicable laws or regulations;
Interfere with, disrupt, or harm our Services;
Access other users’ accounts without permission;
Use AI features for fraudulent or malicious purposes.
11. Intellectual Property
All content, software, designs, and trademarks of Swipely are our property or licensed to us.
You may not copy, reproduce, modify, or distribute our intellectual property without prior written consent.
12. Termination
We may suspend or terminate your account if you:
Violate these Terms;
Engage in fraudulent or illegal activity;
Provide false information or impersonate someone else.
Upon termination:
Your access to the Services will cease;
Swipely may retain certain data for legal, tax, or fraud prevention purposes.
13. Disclaimers
Swipely provides Services “as is” and “as available”;
We do not guarantee job offers, earnings, or specific outcomes;
We are not responsible for employer decisions or third-party content.
14. Limitation of Liability
To the fullest extent permitted by law, Swipely and its affiliates are not liable for:
Indirect, incidental, or consequential damages;
Loss of data, profits, or opportunities;
Any errors in AI-generated content.
Our total liability is limited to the amount you have paid us in the last 12 months.
15. Indemnification
You agree to indemnify and hold harmless Swipely, its affiliates, and employees from claims, damages, losses, or costs arising from:
Your breach of these Terms;
Your misuse of the Services;
Your violation of applicable laws.
16. Governing Law and Jurisdiction
These Terms are governed by the laws of the Netherlands.
Any disputes will be resolved in the courts of the Netherlands.
17. Changes to Terms
Swipely may update these Terms from time to time.
Material changes will be notified via email or app notification.
Continued use of the Services constitutes acceptance of updated Terms.
